1. INTRODUCTION

Welcome to Lucid FM! These Terms and Conditions (“Terms”) govern your use of the Lucid FM mobile application (“App”) created and operated by Deviation Lab (“we,” “us,” or “our”).

By downloading, installing, or using Lucid FM, you agree to be bound by these Terms. Please read them carefully before using the App.

Lucid FM may include features such as AI-generated audio or text, background audio playback, in-app purchases, subscriptions, push notifications, and social login via Google or Apple. Your use of these features is also subject to these Terms.

2. INTELLECTUAL PROPERTY RIGHTS

2.1 OUR RIGHTS

All intellectual property rights in the App remain the exclusive property of Deviation Lab. This includes, but is not limited to:

  • Source code and software
  • Algorithms and AI models used within the App
  • Trademarks, logos, and branding
  • Database rights
  • Design, layout, and user interface
  • All audio, visual elements, and features made available within the App

2.2 PROHIBITED ACTIONS

You may not:

  • Copy, modify, or distribute the App or any part of it
  • Reverse engineer, decompile, or attempt to extract the source code
  • Create derivative works based on the App
  • Use our trademarks, logos, or branding without prior written permission
  • Translate, adapt, or localize the App without authorization

Any unauthorized use of Lucid FM or its content may violate intellectual property laws and these Terms.

3. LICENSE TO USE

We grant you a limited, non-exclusive, non-transferable, revocable license to use Lucid FM for personal, non-commercial purposes, strictly in accordance with these Terms.

You do not acquire any ownership rights by downloading or using the App.

4. APP UPDATES AND MODIFICATIONS

4.1 UPDATES

We may release updates from time to time to:

  • Improve performance or stability
  • Fix bugs or security issues
  • Add, modify, or remove features
  • Ensure compatibility with new OS versions

We do not guarantee continuous compatibility with all devices or OS versions, that updates will always be provided, or that the App will remain available indefinitely.

4.2 YOUR RESPONSIBILITY

You agree to install updates when they are made available in order to maintain optimal performance and security of the App.

4.3 SUBSCRIPTIONS & IN-APP PURCHASES

Lucid FM offers auto-renewable subscription plans and consumable in-app purchases (credits) through Apple In-App Purchase.

Auto-Renewable Subscriptions

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
  • You can manage or cancel your subscriptions at any time by going to your Apple ID Account Settings.
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.

Credits (Consumable Purchases)

  • Credits are digital items that can be used within the App to unlock or access content.
  • Credits are non-transferable, non-refundable, and have no cash value.
  • Credits do not expire under normal circumstances. However, unused credits may become unavailable if required by changes to the App, discontinuation of services, or applicable laws and platform policies.

4.4 PRICING CHANGES

Lucid FM is offered as a commercial service and may include paid subscriptions or one-time in-app purchases. We reserve the right to introduce or modify pricing, change subscription plans, or offer promotions.

Any pricing changes applicable to you will be communicated in advance through the app store listing or within the App, in accordance with the policies of Apple App Store or Google Play Store.

5. DEVICE SECURITY

5.1 YOUR RESPONSIBILITIES

You are responsible for maintaining the security of your device, keeping it charged, protecting your account credentials, and ensuring you have permission to use the device.

Any damage to your device, or loss of data resulting from your use of the App, is your responsibility.

5.2 JAILBREAKING AND ROOTING

We strongly advise against jailbreaking (iOS) or rooting (Android) your device. We are not responsible for any issues caused by the use of jailbroken or rooted devices.

6. PRIVACY AND DATA

The App collects and processes certain personal and technical data in order to provide our services. Your use of Lucid FM is also governed by our Privacy Policy.

By using the App, you agree to the terms of our Privacy Policy.

6.1 YOUR DATA SECURITY

You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. If you suspect unauthorized use of your account, you should notify us immediately.

7. THIRD-PARTY SERVICES

Lucid FM integrates with third-party services, each of which has its own terms and conditions. These may include Google Analytics for Firebase, Firebase Crashlytics, Adapty, and Google/Apple sign-in services.

By using Lucid FM, you also agree to comply with the applicable terms and policies of these third-party providers. We are not responsible for the content, availability, or practices of third-party services.

8. INTERNET CONNECTIVITY AND DATA CHARGES

8.1 CONNECTION REQUIREMENTS

Some features of Lucid FM require an active internet connection. We are not responsible for limitations caused by lack of internet access or unstable connections.

8.2 DATA CHARGES

You are responsible for all charges incurred from using the App, including mobile data charges and roaming charges.

9. LIMITATION OF LIABILITY

9.1 APP AVAILABILITY

We rely on third-party services and cannot guarantee uninterrupted operation. We do not warrant that the App will always meet your specific requirements.

9.2 DISCLAIMER

To the fullest extent permitted by law, we accept no liability for any loss or damage arising from your use of the App, technical failures, or any actions you take based on content accessed through Lucid FM.

Your sole remedy in the event of dissatisfaction with the App is to stop using it and remove it from your device.

10. TERMINATION

We may suspend or terminate your access to Lucid FM at any time if you violate these Terms, if we discontinue the App, or for technical/security reasons.

Upon termination, your license to use Lucid FM immediately ends. You may stop using the App at any time by deleting it from your device.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms or providing in-app notifications. Your continued use of Lucid FM after changes become effective constitutes your acceptance of the revised Terms.

12. GOVERNING LAW

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. The specific governing jurisdiction may depend on your country of residence.
